Terms of service
These Terms of Service ("Terms") govern your access to and use of motorcycleconnection.myshopify.com and any related pages, content and services (together, the "Site"), and every order you place through it. The Site is operated by Motorcycle Connection, trading as Motorcycle Connection ("Motorcycle Connection", "we", "us", "our").
By visiting the Site, browsing products, creating an account or placing an order, you agree to these Terms. If you do not agree to them, please do not use the Site.
Please read the sections on safety, fitment and intended use and limitation of liability carefully. They affect what you can expect from the products we sell and what we are responsible for.
1. Who we are
Motorcycle Connection is an online retailer of motorcycle accessories, care products, riding-adjacent apparel and branded merchandise. We are an independent retailer. We are not affiliated with, endorsed by, or an authorised dealer for any motorcycle manufacturer, and references to a make or model are for description only.
- Legal entity: Motorcycle Connection
- Trading address: 1910 E Front Ave, Bismarck, ND 58504, United States
- Contact: motorcycleconnection76@gmail.com
2. Eligibility and your account
You may use the Site only if you are at least 18 years old, or the age of majority where you live, and can form a binding contract. By placing an order you confirm that this is the case.
You may create an account to check out faster, track orders and save items to your Garage. You are responsible for keeping your password confidential and for everything that happens under your account. Tell us promptly at motorcycleconnection76@gmail.com if you believe your account has been used without your permission.
The Garage is a convenience feature for saving products you are interested in. Saving an item does not reserve it, hold its price, or guarantee availability.
We may refuse service, close an account, cancel an order or limit quantities at our discretion — for example where we suspect fraud, resale, abuse of a promotion, or a breach of these Terms.
3. Products, descriptions and images
We work hard to describe our products accurately, but we do not warrant that descriptions, specifications, images, packaging or other content on the Site are error-free, complete or current. Product photography is illustrative: colours vary between screens, and finishes, packaging and minor design details may differ from the images shown.
Sizing charts and fitment notes are supplied as a guide. Manufacturer sizing is inconsistent across brands and can change between production runs.
All products are offered subject to availability. We may change or discontinue any product at any time without notice, and we may limit the quantity of any product we sell to any person or order.
4. Safety, fitment and intended use
This section matters more than any other in this document. Read it before you buy.
Motorcycle Connection sells accessories, care products, casual apparel and branded merchandise. Unless a product page explicitly states a certification (and names the standard and the certifying body), our products are not certified personal protective equipment and must not be relied on as protective gear.
- Branded apparel is casual clothing. Our t-shirts, hoodies, caps, beanies and similar items are lifestyle apparel. They are not abrasion-resistant riding gear, they contain no impact armour, and they offer no crash protection of any kind.
- Nothing we sell replaces proper riding gear. A helmet, certified jacket, gloves, trousers and boots that meet the standards required where you ride remain your responsibility.
- Fitment is your responsibility. You are responsible for confirming that a product fits your motorcycle, your body and your intended use before you buy, and for installing and securing it correctly. Follow the manufacturer's instructions. If you are unsure, have it fitted by a qualified professional.
- Mounted accessories must not compromise control. Phone mounts, bags, covers and similar accessories must be fitted so they do not obstruct your view, foul the controls, interfere with steering or suspension travel, or come loose in motion. Check them before every ride.
- Do not operate a device while riding. A phone mount is for hands-free viewing where that is lawful. Interacting with a mounted device while the motorcycle is moving is dangerous and illegal in many places.
- Local law is yours to check. Rules on eyewear tint, helmet standards, lighting, noise, mirrors, mounted devices and cargo differ by country, state and province. You are responsible for ensuring that what you buy is legal to use where you ride.
- Use products only as intended. Care and cleaning products must be used strictly according to their labels, kept away from brake surfaces, tyres and heat sources, and stored out of reach of children.
Riding a motorcycle is inherently risky. Nothing sold on this Site removes that risk, and no product should be treated as making an unsafe ride safe.
5. Ride Kits and bundles
Ride Kits are bundles sold as a single product at a single price. Kit contents are listed on the product page and may change over time; where an item is unavailable we may substitute a comparable item of equal or greater value, and we will tell you if we do.
Kit pricing applies to the kit as a whole. Individual items within a kit are not sold separately at the kit's per-item rate, and kits are returned as complete kits — see returns.
6. Pricing, currency and taxes
Prices are shown in United States dollars (USD) and exclude shipping unless stated. Prices, promotions and shipping thresholds may change at any time without notice, and a change does not entitle you to a refund on an order already placed.
Applicable sales tax, VAT or GST is calculated at checkout based on your delivery address and the rules that apply to it.
Despite our best efforts, a product may occasionally be listed at an incorrect price or with incorrect information. Where a product's correct price is higher than the price shown, we may cancel the order and refund you in full, or contact you before dispatch so you can confirm the corrected price or cancel. We are not obliged to sell at an incorrect price, even after an order confirmation email has been sent.
7. Orders and acceptance
Your order is an offer to buy. The order confirmation email we send when you check out acknowledges that we received it — it is not acceptance. The contract between us forms when we dispatch the goods, or when we email to say the order has been accepted, whichever comes first.
We may refuse or cancel any order, in whole or in part, including after confirmation — for example where stock is unavailable, where the listing contained an error, where we cannot verify payment or the delivery address, or where we suspect fraud or resale. If we cancel an order you have paid for, we refund the amount charged for the cancelled items in full.
8. Payment
Payments are processed by Shopify and its payment providers. We do not receive or store your full card details. By submitting payment details you confirm that you are authorised to use the payment method and that the information you provide is true, accurate and complete.
Where an accelerated checkout (such as Shop Pay, PayPal or a wallet button) is used, that provider's own terms apply to the payment in addition to these Terms.
9. Shipping, fulfilment and delivery
Our products are shipped from a network of third-party suppliers and fulfilment partners. This has two practical consequences you should expect:
- Split shipments. An order containing several items may arrive in separate parcels, from different locations, on different days, with separate tracking numbers. Nothing is missing until every parcel has arrived.
- Estimates, not guarantees. Dispatch and delivery windows shown on the Site, in cart or in emails are good-faith estimates. They are not guaranteed delivery dates, and they can be affected by supplier processing, carrier delays, weather, customs and peak periods.
Risk of loss passes to you when the carrier delivers to the address you supplied. You are responsible for giving us a complete, accurate delivery address; we are not liable for orders delayed or lost because of an address error you made, and re-shipping may incur a further charge.
For international orders, you are the importer of record. Any customs duties, import taxes, brokerage or handling fees are your responsibility, are charged by your local authorities rather than by us, and are not included in the price you pay at checkout. Refusing a parcel to avoid these charges does not entitle you to a full refund; we will refund the price of the goods less our outbound and return shipping costs where the goods reach us.
Full details are in our Shipping Policy, which forms part of these Terms.
10. Returns, refunds and cancellations
Our Refund Policy sets out how returns work, what we can accept, and how long you have. It forms part of these Terms.
In summary, and subject to that policy: unused items in their original, undamaged packaging may be returned within 30 days of delivery. For hygiene and safety reasons we cannot accept returns of items that have been worn, used, fitted, or had a security seal broken — including opened care and cleaning products. Ride Kits must be returned complete.
Statutory rights that apply where you live — including any cooling-off or right-to-cancel period, and rights in respect of faulty or misdescribed goods — are unaffected by anything in these Terms.
11. Promotions and discount codes
Discount codes, promotional pricing and free-shipping thresholds are valid for the period and on the terms stated, cannot be exchanged for cash, and cannot be combined with other offers unless we say so. One code per order unless stated. We may withdraw or amend a promotion at any time, and we may void a discount used in breach of its terms or obtained by manipulation.
Where a promotional threshold is met using items that are later returned, we may deduct the value of the benefit received from your refund.
12. Reviews, submissions and other content you send us
If you post a review, comment, photograph, suggestion or other material, or send it to us by any channel, you grant us a non-exclusive, worldwide, royalty-free, perpetual and transferable licence to use, reproduce, adapt, publish and display it in connection with our business, including in marketing. You confirm that the content is yours to give and does not infringe anyone else's rights.
You agree not to submit anything unlawful, abusive, defamatory, obscene, misleading, or containing malware or another person's private information. We may edit, refuse or remove any submission at our discretion, and we are under no obligation to publish, monitor or keep any submission confidential, or to pay for it.
13. Acceptable use
You agree not to use the Site or its content:
- for any unlawful purpose, or to solicit anyone else to do anything unlawful;
- to breach any regulation, rule or law in your jurisdiction or ours;
- to infringe our intellectual property rights or anyone else's;
- to harass, abuse, defame, intimidate or discriminate against anyone;
- to submit false or misleading information, or to impersonate another person;
- to upload or transmit viruses or any other code that will affect the functionality of the Site or anyone's device;
- to scrape, crawl, harvest or index the Site or its data by automated means, or to circumvent any security feature;
- to interfere with or place undue load on the Site or the networks it runs on.
We may terminate your access for breaching any of the above.
14. Intellectual property
The Motorcycle Connection name, logo, shield mark, the slogan "Ride Equipped. Ride Connected.", and the design, text, graphics, photography and code of the Site are owned by or licensed to us and are protected by copyright, trade mark and other laws. You may not copy, reproduce, republish, modify or distribute any part of the Site for commercial purposes without our prior written permission.
Third-party brand names, logos and product images belong to their respective owners and are used to identify products only. Their use does not imply affiliation or endorsement.
15. Third-party links, apps and services
The Site may link to, or make available, third-party websites, tools and services that we do not control — including payment providers, shipping carriers, review platforms, analytics and marketing tools. We provide them "as is" and without warranty, we are not responsible for their content, accuracy, privacy practices or availability, and any dealings you have with a third party are between you and them. Review their terms before you use them.
16. Privacy
How we collect and use personal information is set out in our Privacy Policy, which forms part of these Terms.
If you opt in to marketing emails or SMS you can withdraw consent at any time using the unsubscribe link, the stated opt-out keyword, or by contacting motorcycleconnection76@gmail.com. Message and data rates may apply to SMS.
17. Site availability and accuracy
We do not guarantee that the Site will be uninterrupted, timely, secure or error-free, or that results obtained through it will be accurate or reliable. We may suspend, withdraw or change all or part of the Site without notice, and may discontinue it entirely at any time.
Nothing on this Site is advice on which you should rely for mechanical, legal, safety or purchasing decisions. Where content addresses fitment, maintenance or riding, it is general information only, may be out of date, and is no substitute for the manufacturer's instructions or a qualified professional's judgement.
18. Disclaimer of warranties
Except as expressly stated in these Terms or required by law, the Site, its content and the products sold through it are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, durability, title and non-infringement.
Products may carry a manufacturer's warranty. Where one exists, it is offered by that manufacturer on its own terms; we will help you make a claim under it, but we do not extend or replace it.
19. Limitation of liability
To the fullest extent permitted by law, Motorcycle Connection, Motorcycle Connection and our officers, employees, agents and suppliers will not be liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of profit, revenue, data, goodwill or anticipated savings, arising out of your use of the Site or any product bought through it, whether the claim is in contract, tort (including negligence), strict liability or otherwise, and even if we have been advised of the possibility of such loss.
Where liability cannot be excluded, our total aggregate liability to you in connection with any order is limited to the amount you paid for that order.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of this section may not apply to you.
20. Indemnification
You agree to indemnify and hold harmless Motorcycle Connection and our officers, employees, agents and suppliers from any claim or demand, including reasonable legal fees, made by a third party and arising out of your breach of these Terms, the documents they incorporate, or any law or the rights of a third party.
21. Changes to these Terms
We may update these Terms at any time by posting a revised version on this page and changing the "last updated" date. Changes take effect when posted. The version in force when you place an order is the version that governs that order. It is your responsibility to check this page periodically.
22. Governing law
These Terms and any dispute arising from them are governed by the laws of the State of North Dakota, United States, without regard to its conflict of law provisions. You and we agree to the exclusive jurisdiction of the state and federal courts located in Burleigh County, North Dakota, except that either party may seek injunctive relief in any court of competent jurisdiction. Consumers may have the right to bring proceedings in the courts of the country where they live, and nothing here removes that right where it applies.
23. General
If any provision of these Terms is found to be unlawful or unenforceable, it will be enforced to the fullest extent permitted and severed from the rest, which will remain in force. Our failure to exercise or enforce any right is not a waiver of it.
These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy and any other policies posted on the Site, form the entire agreement between you and us and supersede any prior agreements or communications. Any ambiguity is not to be construed against us as the drafting party.
You may not assign or transfer your rights under these Terms. We may assign ours in connection with a merger, acquisition or sale of assets.
24. Contact us
